The Parties agree the Treaty Authority has the following further functions conferred by the Statewide Treaty Act, the Treaty Authority Act and other Acts amended by the Statewide Treaty Act as specified in this schedule:
- Where requested in accordance with the internal rules of Gellung Warl (the Rules), facilitating the resolution of, or otherwise assisting in dealing with:
- an allegation of misconduct or serious misconduct by a Gellung Warl official;
- a complaint in relation to other matter in respect of which a complaint could be made under section 166 of the Statewide Treaty Act that is specified in the Rules; and/or
- a complaint in relation to how Gellung Warl is meeting its community answerability responsibilities set out at Part 14 of the Statewide Treaty Act, by
- Giving advice;
- Providing mediation or other dispute resolution; and/or
- Doing any other thing to assist in facilitating dealing with the allegation.
- Providing mediation or other dispute resolution; and/or
- Doing any other thing to assist in facilitating dealing with the allegation.
- Where a complaint is made to the Treaty Authority in accordance with the Rules about:
- a decision of the Electoral Officer relating to enrolment or eligibility for enrolment on Gellung Warl electoral roll;
- any matter relating to the conduct or the administration of an election; and/or
- any other matter relating to an election specified in the electoral rules,
- the Treaty Authority will respond to that complaint in accordance with the Rules, by doing any of the following to facilitate the resolution of or otherwise assist in dealing with the complaint:
- request information from Gellung Warl, the complainant and any other person the Treaty Authority considers relevant;
- provide advice to Gellung Warl; and
- do any other thing to assist in facilitating the resolution of the electoral complaint.
- Dissolving the First Peoples’ Assembly of Gellung Warl in accordance with the process described at Part 16 of the Statewide Treaty Act.
- Providing advice to any of the following integrity agencies, where requested by those integrity agencies:
- Independent Broad-based Anti-corruption Commission;
- Auditor-General;
- Victorian Information Commissioner;
- Keeper of Public Records;
- Integrity Oversight Victoria; and
- Ombudsman,
about the establishment of cultural safety guidelines required to be established for those integrity agencies by Statewide Treaty Act amendments to the following Acts in respect of the Auditor-General, the Independent Broad-based Anti-Corruption Commission, Integrity Oversight Victoria, the Victorian Information Commissioner, the Keeper of Public Records and the Ombudsman:
- Audit Act 1994 (Vic);
- Independent Broad-based Anti-corruption Commission Act 2011 (Vic);
- Integrity Oversight Victoria Act 2011 (Vic);
- Freedom of Information Act 1982 (Vic);
- Privacy and Data Protection Act 2014 (Vic);
- Public Records Act 1973 (Vic); and
- Ombudsman Act 1973 (Vic).
- Being consulted on any proposed Bill to which Part 17 of the Statewide Treaty Act applies.
- Providing a response to any consultation statement prepared as part of the procedure to amend the Statewide Treaty Act under Part 17 of the Act.
- Making a submission in accordance with section 188 of the Statewide Treaty Act in response to any Bill that proposes to repeal the Statewide Treaty Act in whole or in part or proposes to abolish Gellung Warl.
- For the purposes of the Treaty Authority Act (as amended by the Statewide Treaty Act):
- Appoint a person employed by the Treaty Authority to be the Electoral Officer;
- Set the terms and conditions of employment for the Electoral Officer;
- Employ any staff that are necessary for the purpose of the Electoral Officer's functions;
- Engage any consultants to assist for the purposes of the Electoral Officer's functions; and
- Vacate the office of the Electoral Officer where any of the circumstances described at section 20(4) of the Treaty Authority Act arise.
- The Electoral Officer has the functions of:
- administering Gellung Warl's electoral roll and enrolment process for elections under the Statewide Treaty Act;
- conducting elections and Gellung Warl plebiscites under the Statewide Treaty Act and the electoral rules; and
- performing any functions conferred on the Electoral Officer under the Treaty Authority Act, any other Act or the electoral rules.
