How to consider cultural heritage in your proposed development or project

• the development of one or two dwellings (r.9)
• 3 or more dwellings on a small lot (r.10)
• Small subdivisions (r.11)
• Buildings and works ancillary to a dwelling (r.12)
• Services to a dwelling (r.13)
• Alteration of buildings (r.14)
• Minor works (r.15)
• Demolition (r.16)
• Consolidation of land (r.17)
• Subdivision of existing building (r.18)
• Jetties associated with one dwelling (r.19)
• Development of the Sea-bed (r.20)
• Emergency works (r.21).

Exempt activities are described in the Aboriginal Heritage Regulations 2018 (Victorian Law Today - statutory rules) at Part 2, Division 2.

Generally includes larger scale buildings and works that will cause r oresult in ‘significant ground disturbance’.

For example:

• the construction of three or more dwellings
• subdivisions of three or more lots
• mining and quarrying
• timber production.

These include:

• registered Aboriginal places
• waterways, ancient lakes and Ramsar wetlands
• coastal land, dunes and sand sheets.

Disturbance of the topsoil or surface rock layer of the ground or a waterway by machinery in the course of grading, excavating, digging, dredging or deep ripping.

Generally, a cultural heritage management plan (CHMP) is not required in areas that have already been heavily developed. This is because the significant ground disturbance from the development means an area is no longer an area of cultural heritage sensitivity.
